The Online Safety Bill is a good measure designed to protect children from harmful content on the internet. However, it has been criticised by free speech campaigners for giving the Government unprecedented powers to designate “harmful” content. They fear this could lead to “political censorship” online if social media companies are required to remove speeches and comments deemed to be unacceptable.

Critics want the Government to drop Clause 13 of the Bill, which enacts the plans to regulate legal but harmful content. It would create a perverse position whereby people are prohibited from saying things online that are lawful to say offline.

The Commons culture committee has voiced “urgent concerns” that the draft legislation neither adequately protected freedom of expression nor was robust enough to tackle the various types of illegal and harmful content on user-to-user and search services.

Nadine Dorries, the Secretary of State, has amended the Bill to disallow the arbitrary removal of content deemed to be “inappropriate”. Concerns remain, however, over the regulatory independence of Ofcom, which is vital to the success of the framework. The Bill allows too great a degree of executive control and interference by government ministers, something Julian Knight, the culture committee chairman, called a “power grab” that risked undermining a free press.

The real problem is that the legislation has expanded beyond what was intended, which was to protect children. The Bill will soon go to the House of Lords, where the original aim of shielding young people from the pernicious impact of social media platforms needs to be restored.
